1. Introduction

Welcome to PASARA SURF ("Platform", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the PASARA SURF website and mobile application, including all content, features, and services offered through the Platform.

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

2. Role of the Platform

PASARA SURF is an online marketplace that enables communication between buyers and sellers of surfboards, surf equipment, and related goods and services in Bali, Indonesia. The Platform serves exclusively as a communication and listing tool to connect buyers with sellers.

We do not inspect, certify, or guarantee the quality, safety, legality, or accuracy of any listings, products, or services posted on the Platform. Users interact and transact entirely at their own risk and discretion.

3. User Accounts

To access certain features of the Platform, you must create an account. When creating and maintaining your account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Listings & User Content

When creating listings or posting content on the Platform, you represent and warrant that:

• You are the lawful owner of the item or are authorized to sell it
• All information in the listing is accurate, complete, and not misleading
• The item does not infringe on any third-party intellectual property rights
• The listing complies with all applicable local laws and regulations in Bali, Indonesia

PASARA SURF reserves the right to remove any listing or content that violates these Terms, is reported by other users, or is deemed inappropriate at our sole discretion, without prior notice.

5. Transactions & Disclaimer

All transactions, including but not limited to negotiations, pricing agreements, payment transfers, item inspections, and handovers, are conducted privately between the buyer and seller. PASARA SURF bears no responsibility for the outcome of any transaction.

We strongly recommend that buyers inspect all items in person before completing any purchase. Meet in public, well-lit locations. Verify the condition and authenticity of items before exchanging payment.

PASARA SURF shall not be liable for any loss, damage, injury, dispute, or claim arising from or related to any transaction between users, including but not limited to defective products, misrepresented items, non-delivery, fraud, or personal safety incidents.

6. Prohibited Conduct

You agree not to use the Platform for any of the following purposes:

• Posting false, misleading, or fraudulent listings or content
• Engaging in harassment, threats, or abusive behavior toward other users
• Attempting to circumvent Platform features, security measures, or access restrictions
• Using the Platform to sell stolen, counterfeit, or prohibited items
• Collecting or harvesting personal data of other users without consent
• Using automated bots, scrapers, or similar tools to access the Platform

7. Limitation of Liability

To the maximum extent permitted by applicable law, PASARA SURF, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Platform.

Our total aggregate liability to you for any claims arising from your use of the Platform shall not exceed the amount you have paid to PASARA SURF, if any, during the twelve (12) months immediately preceding the event giving rise to the claim.

8. Intellectual Property

All content, trademarks, logos, designs, and software on the Platform are the property of PASARA SURF or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without prior written permission from PASARA SURF.

9. Account Termination

PASARA SURF reserves the right to suspend or terminate your account at any time, with or without cause and with or without notice, including but not limited to violations of these Terms. Upon termination, your right to access and use the Platform ceases immediately. Any content you have posted may remain on the Platform at our discretion.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from or related to these Terms or your use of the Platform shall be resolved through amicable negotiation first. If no resolution is reached within thirty (30) days, the dispute shall be submitted to the competent courts in Denpasar, Bali, Indonesia.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on the Platform and updating the "Last Updated" date at the top of this page. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
